The Court granted a writ of certiorari to review the court of appeals' opinion in Wellborn v. City of Rock Hill, No. 2013-002580, 2015 WL 4755711 (Ct. App. August 12, 2015).

2016-001303   The State, Respondent, v. Shawn Lee Wyatt, Petitioner.

Appellate Defender Lara M. Caudy, of Columbia, for Petitioner. Attorney General Alan Wilson and Assistant Attorney General William M. Blitch, both of Columbia and Solicitor Randy E. Newman, Jr., of Lancaster, for Respondent.

Shawn Lee Wyatt was convicted of attempting to furnish contraband to a prisoner and possession with intent to distribute cocaine, cocaine base, and marijuana. Wyatt appealed his conviction, arguing the trial court erred in denying his motion to suppress two identifications that Wyatt argues were unduly suggestive and unreliable. The court of appeals affirmed the trial court's decision in State v. Wyatt, Op. No. 2016-UP-162 (Ct. App. filed April 6, 2016). Wyatt filed a petition for a writ of certiorari, which the Court granted.

The Court agreed to rehear this case following the filing of Op. No. 27693 on December 29, 2016, wherein the Court discussed the trial judge's use of certain terms in his opening remarks to the jury and the content requirements of a divided closing argument, and affirmed Beaty's conviction.
